Terms of Service
Effective date: October 15, 2026
These terms are an agreement between BloomCare System LLC, a Texas company ("we", "us"), and the organization that subscribes to BloomCare ("you"). By creating an account or using BloomCare, you agree to them. If you accept on behalf of an organization, you confirm you are authorized to do so.
The service
BloomCare is web-based child care management software: enrollment and eligibility forms, parent signing links, attendance and meals, claims and reports, center records and staff logins, and sponsor oversight. We may improve or change features over time without reducing the core service during a paid term.
Delivery
BloomCare is delivered online. Nothing is shipped. Your logins work as soon as your account is set up, and we confirm setup by email.
Accounts
- You are responsible for the logins you create and the permissions you give them.
- Keep passwords private and tell us at support@bloomcare.com if you suspect misuse.
- You must give accurate account and billing information.
Your data
You own the records you enter into BloomCare. You give us permission to host and process them only to provide the service to you. You are responsible for having the right to collect and enter that information, including any consent required from families. Our handling of personal information is described in the Privacy Policy.
Acceptable use
Do not misuse BloomCare. This includes trying to access other customers' data, interfering with the service, uploading harmful code, or using it for anything unlawful. We may suspend access that puts the service or other customers at risk.
Fees and billing
- Subscriptions are billed in advance, monthly or yearly, at the price shown when you subscribe or in your order.
- Subscriptions renew automatically for the same period unless cancelled before the renewal date.
- Prices are in US dollars (USD) and do not include taxes, which are added where required.
- Card payments are processed by Stripe, which is certified to PCI DSS Level 1. We never see or store full card numbers.
- We will give at least 30 days' notice of a price change; it applies from your next renewal.
- Cancellations and refunds follow our Refund and Cancellation Policy.
Term and ending the agreement
These terms apply while you have an account. You may cancel at any time. We may end or suspend the service for non-payment or a serious breach of these terms, with notice where practical. After the account ends you may request an export of your records within 60 days.
Availability and support
We aim to keep BloomCare available at all times, apart from planned maintenance. Support is by email at support@bloomcare.com.
Warranty disclaimer
BloomCare is provided "as is". We do not promise it will be error-free or that it meets every program rule that applies to you. You remain responsible for the accuracy of the claims and reports you submit to any agency.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability is limited to the fees you paid us in the 12 months before the claim.
Governing law
These terms are governed by the laws of the State of Texas. Disputes will be handled in the state or federal courts located in Cameron County, Texas.
Changes to these terms
We may update these terms. We will post the new version here with a new effective date and email account owners about significant changes. Continued use after that date means you accept them.
